Welcome to Alfalicious!  We hope you find this site entertaining and fun.

Alfalicious is owned an operated by May Moon Media, LLC (“MMM”).  This Terms of Use covers all Content made available by MMM including, but not limited to, Content on this site, email correspondence with MMM , and RSS feeds. Please read this statement carefully before proceeding to access MMM Content. Your use of this site indicates your agreement to abide by the Terms of Use in effect.

1. General Disclaimer

All Content provided on MMM is for entertainment purposes only and is provided “as is”.  The Content on this site is often fictitious, exaggerated, or incomplete and is not intended to be used as a reference of facts.  MMM makes no representations as to the accuracy or completeness of any information on this site or found by following any link on this site. The owners will not be liable for any errors or omissions in this information nor for the availability of this information. The owners will not be liable for any losses, injuries, or damages from the display or use of this information.


2. Use of Content

All of the Content on MMM is protected by U.S. and international copyright laws and is the property of MMM and/or providers of the Content under license. By “Content” we mean any information, mode of expression, image, video, audio, or other materials and services found on MMM.

You may make one copy of the Content for your personal, non-commercial use, provided that any material copied remains intact and includes the following notice: “Copyright 2011 May Moon Mdedia, LLC. All rights reserved.” Any other copying, distribution, storing, or transmission of any kind, or any commercial use of our Content, is prohibited without prior written permission from MMM.  Do not be shy in writing us for permission, especially if you are operating a not-for-profit organization or club or association that shares our passion for Alfa Romeo or other great automobiles.

The Alfalicious logo is a trademark of MMM, and you agree not to display any of our trademarks or use them in any manner without our express written permission.

3. Correspondence with MMM

MMM does not claim ownership of Content you submit to us.  However, with respect to any Content you submit to us, you grant MMM a worldwide, royalty-free, non-exclusive, perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

Furthermore, in submitting Content to us, you are representing that the Content is yours to give to us, does not infringe on any third party’s rights – copyright, trademark, privacy rights and the like – and is not libelous or unlawful in any other way.

4. Commenting on Alfalcious

Alfalicious makes commenting possible using a Facebook account.  As such, commenting on Alfalcious may not be possible anonymously. MMM will not accept responsibility for information posted in the Comments.  Alfalicious aims to promote a fun, entertaining forum for discussion via its commenting section, and reserves the right to remove any comment for any reason.  The following guidelines have been established for users intending to comment on Alfalicious:

a. Do not post threatening, harassing, defamatory, or libelous material.
b. Do not offer to sell or buy any product or service.
c. Do not post material that infringes copyright or any other intellectual property interest.
d. Do not post information that you know to be confidential or sensitive or otherwise in breach of the law.
e. Keep all comments relevant to the Content where the comment is being posted.

5. Images, Video, and other Media

Alfalicious typically display images, audio, and video (the “Material”) as part of blog posts written by our editors. The types of Material editors are authorized to use on Alfalicious include:

a. Original Material created or authored by our editors;
b. Material licensed from photographic archive and video vendors;
c. Material supplied to our editors or released into the public domain by public relations and marketing companies for press purposes;
d. Reader-submitted Material, with the implied representation that the person submitting the material owns the copyright in the material and the right to give it to us for use on Alfalicious;
e. Material published on other sites with licenses granted under Creative Commons, with attribution in accordance with the Creative Commons license granted in each case;
f. Material that we believe to be covered by the Fair Use Doctrine, taking into account factors such as:

(i) The purpose and character of the use (i.e. transformation from the original, use for criticism, satire or parody
(ii) The nature of the copyrighted work (i.e. factual or newsworthy versus creative works)
(iii) The amount and substantiality of the portion used in relation to the whole (i.e. use of cropped, reduced, low-resolution Material used for no more than to convey the point made)
(iv) The effect on the potential market for the copyrighted work (e.g. use that is not substitutive for the original, or would never be licensed in any event)

6. Copyright Complaints

MMM respects the intellectual property of others, and requires that our users do the same. If you believe that your work has been copied and is accessible on this site in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please contact us via the Contact page on this site for reporting copyright infringements.

To enable us to address your concerns, please provide the following information:

a. For each allegedly infringing image, video or piece of text that you wish to have removed from one of our sites, provide the exact permanent URL for the page containing the material.
b. Provide information reasonably sufficient to permit us to contact you: an email address is preferred, as well as a telephone contact number.
c. For images, provide the following information detailing your claim to ownership of the copyright in the allegedly infringing image:
d. Proof of copyright in the image concerned, namely proof of registration of the Image under the DMCA; OR, absent such registration, a detailed description of where the photograph was taken, by whom, who or what the subject of the image is, and evidence to support your claim that you own the copyright in the image. We will not comply with requests to remove an image where the complainant cannot prove that they own the copyright in the image in question.
e. Include the following statement: “I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
f. Sign the document and email it to legal [at] alfalicio.us

Please note that you will be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that any material on our sites is infringing your copyrights.

We also reserve the right to publish your letter on Alfalicious.

7. Changes to this Terms of Use

MMM retains the right to make modifications to these Terms of Use from time to time, without advanced notice.
